Mahkamah Tinggi di sini hari ini menolak dengan kos permohonan Menteri Pertahanan, Datuk Seri Dr. Ahmad Zahid Hamidi untuk membatalkan saman malu yang difailkan oleh seorang usahawan terhadap beliau, tiga tahun lepas.
Pesuruhjaya Kehakiman, Datuk Zaleha Yusof membuat keputusan itu di dalam kamarnya hari ini.
Mahkamah juga memberi tempoh selama sebulan kepada Ahmad Zahid untuk memfailkan pernyataan pembelaannya berhubung saman itu.
Pada 4 Julai 2007, Amir Bazli Abdullah, 39, selaku plaintif memfailkan saman malu itu terhadap Ahmad Zahid selaku defendan.
Dalam saman itu, Amir Bazli mendakwa Ahmad Zahid menumbuk muka beliau dalam satu kejadian pada 16 Januari 2006 dan menuntut sejumlah ganti rugi yang akan ditentukan oleh mahkamah.
Pada 29 Ogos 2007, Ahmad Zahid memfailkan permohonan untuk membatalkan saman malu itu dengan alasan ianya mengaibkan dan remeh-temeh.
Amir Bazli dalam pernyataan pembelaannya pula mendakwa permohonan Menteri itu untuk membatalkan saman malu tersebut adalah satu penyalahgunaan proses mahkamah dan tidak berasas.
Beliau diwakili peguam Karpal Singh dan Sangeet Kaur Deo sementara Ahmad Zahid diwakili peguam Shashi Menon dan Shamsul Bahrain Ibrahim. - Bernama

Malay supremacy not mentioned in Constitution, says historian
He said that from the historical aspect, only the Rulers’ Supremacy was stated in the constitution where the people must show their loyalty to the Rulers.
“In the past, ‘Malay Supremacy’ was never mentioned within the Malay community. In history, such things are incorrect. What is stated in the Constitution is only the Rulers’ Supremacy, where you show loyalty to the state where you reside in.
“The Malays obtained the special privileges because they are the subjects of the Ruler. The position of the Malays is given special consideration and need not be disputed,” he said when contacted by Bernama, here tonight.
He was asked to comment on the statement by Parti Keadilan Rakyat (PKR) president Datin Seri Dr Wan Azizah Wan Ismail on the Malay Supremacy in her policy speech at the 7th National Congress of the party on Sunday.
Dr Wan Azizah called for the abolition of the concept of Malay Supremacy to enable Malaysian children to grown up with the vision of a ‘race of integrity’ or ‘Malay of Integrity’.
Khoo said the terminology ‘Malay Supremacy’ was only raised by politicians purely for political purposes, and he observed that politicians were now frequently raising issues that could lead to racial confrontations.
“Politicians should focus on their services to the public, helping the people. They should not encourage the people to quarrel,” he said.
Meanwhile, the Director of the Institute of Ethnic Studies, Universiti Kebangsaan Malaysia (UKM), Prof Datuk Dr Shamsul Amri Baharuddin shared Khoo’s opinion that the term Malay Supremacy was coined by politicians in portraying the political and economic position of the Malays.
Questioning Dr Wan Azizah’s motive in raising the issue, he said the statement by the wife of PKR de facto leader, Datuk Seri Anwar Ibrahim, was merely a political gimmick and purely to cover up the crisis faced by the party currently.
“I don’t know why the issue was raised. What I notice is “Anwar’s Supremacy” in the PKR. It is Anwar’s Supremacy that must be abolished. The Malay Supremacy is merely to demolish Anwar’s Supremacy. In my opinion, the concept (Malay Supremacy) does not exist,” he said.
He said Dr Wan Azizah should re-examine what was meant by the term supremacy and should not question the special privileges of the Malays which had been enshrined ever since the era of the Malay Sultanate.
Shamsul Amri said that looking from the economic aspect, the Chinese community dominated 70 per cent of the economy while the Malays had only 30 per cent and there was no such thing as the Malays dominating in all aspects.
“If we look at it, the 70 per cent should be the supreme group. So, what does the Malay Supremacy show? What does supremacy mean? She (Dr Wan Azizah) herself is not clear on the meaning of supremacy,” he said.
Dr Shamsul Amri said politicians should be thinking about issues that were relevant for discussion instead of raising issues that could bring about negative developments between the races. — Bernama

I'm a third generation Malaysian who had served the Malaysian Armed Forces for 38 devoted years. The article in STAR Page N14 recently which carried derogatory remarks by the Malaysian Defence Minister about non-Malays not only jolted me out of my slumber but also infuriated me. The Defence Minister, Ahmad Zahid Hamidi announced that one of the possible reasons for the low intake of non-Malays in the Malaysian Armed Forces (MAF) is that their "patriotism spirit is not high enough"!
It must be acknowledged that the UMNO-led Government is promising a lot of reforms and taken initiatives that appear to be commendable but whilst the'Gods are willing, the priests are not'. The implementation on the ground, as always, has been an issue to which they conveniently close an eye or even both. The BTN inculcation is another monster that the UMNO Government, under the 'able' leadership of our not-so-pendatang PM Dr Mahathir, has created. The evil of BTN must be systemically reversed or we are all doomed and extremists like Zahid Hamidi, who are politically ambitious, who will not hesitate to play the race card again in order to rise within the ranks of UMNO, must be condemned by all right thinking members of the Malaysian society.

Ironically, if my memory serves right, in 1998 this same Zahid Hamidi spoke out against then Prime Minister Tun Dr. Mahathir Mohamad, calling for an end to cronyism and nepotism in the Malaysian government. Zahid, then seen as an ally of deposed Deputy Prime Minister Datuk Seri Anwar Ibrahim, was subsequently arrested and held in prison under the Internal Security Act. Like in most Government Departments, non-Malays are not appointed in certain sections of Departmental Work where it entails transparency. Thus is the case of the MAF Recruiting Division and several other fields purely at the discretion of those placed in power, and this power is abused with the tacit approval of those walking the Corridors of Power. The MAF Recruiting Division over the years has been hoodwinking the public by manipulating the application figures. There are ample cases where applications by well qualified non-Malay candidates have either ended up in waste paper baskets or rejected with fictitious excuses. On the other hand, the lesser ones are either called up and rejected as not qualified or a token sum is absorbed in order to just satisfy the political masters and project the multi-racial composition of the MAF. These poor fall guys end up being miserable with no future in their career. They simply mark time and quit service later into oblivion. What career prospects await the non-Malay today in the Government's service? All the senior positions held by non-Malays are quickly and promptly replaced by Malays when these non-Malays retire. Non-Malays who are competent, able and well qualified are by-passed and these promotions are then given to Malays who are less qualified, less competent but have the 'kulit-ifications'. When compared to the Malays, there is absolutely no career planning for non-Malays and thus stifling their promotion prospects which is further acerbated by the self imposed quota system. This pathetic situation obviously doesn't augur well for potential candidates to join the MAF. The non-Malays are made to feel that they are there merely as gap-fillers despite their earnest portrayal of professionalism, loyalty and patriotism. Unfortunately, many of our politicians like Zahid Hamidi, are either too inexperienced or simply too naive to understand the frustration and agony of highly devoted non-Malays who had served and are still serving our beloved! nation. You should wake up and spend time amongst service personnel to see the mutual respect and camaraderie that exists regardless of race, creed and colour! You and your Cabinet counterparts, in consultation with the Service Chiefs, should devote your time to address the root cause for this long overdue predicament of the Non-Malays. By the way, this was never the case in the 60s and 70s. Another product of BTN and Dr Mahathir's style of helping the handicapped Malays to stay on top despite the odds and the non-Malays are again made scapegoats.
"As there are Chinese and Indians in PKR, the party leaders want to please them as they hope to capitalise on the issue in the next general election," he said after witnessing the signing of contracts for players of the Malaysian Armed Forces team in the Malaysian Football League's coming season, here Monday.
Zahid was referring to PKR president Datin Seri Dr Wan Azizah Wan Ismail's keynote address at the party's 7th Annual National Congress on Saturday, in which she said the Malay supremacy concept should be abandoned so that the younger generation would grow up with the vision of "honourable nation" or "honourable Malay".
He said the statement was aimed at scoring points with the people as the party was faced with allegations of fraudulent practices during its election to the central leadership council.
On the promise by PKR de facto leader Datuk Seri Anwar Ibrahim that DAP advisor Lim Kit Siang would be made deputy prime minister if the opposition pact wins the 13th general election, Zahid said Lim should not be daydreaming about Anwar's sweet promise.
"Enough of Sept 16, when Anwar tried to be the champion...to be prime minister, to take Putrajaya, but Sept 16 already came and went twice.
"I think with the court case he's facing now and his flip-flopping on various issues, the people will reject him," he said.
